STATE OF GEORGIA COUNTY OF LOWNDES NOTICE OF SALE UNDER POWER CONTAINED IN SECURITY DEED Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from 10819 HWY 280 Investments, LLC, a Georgia limited liability company ("Borrower") to South Coast Bank and Trust ("Lender"), dated February 28, 2024, and recorded on March 5, 2024, in Deed Book 1660, Page 236 et seq., in the Bryan County, Georgia deed records (the "Security Deed"); said Security Deed being given to secure payment and performance of the following loan made, extended, or renewed by Lender: that certain Promissory Note from Borrower in favor of Lender dated February 28, 2024, in the original principal amount of Three Million One Hundred Fifty Thousand and 00/100 Dollars ($3,150,000.00), as well as any and all amendments and modifications thereto (the obligations owing by Borrower being referred to as the "Indebtedness"), there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Bryan County, Georgia, within the legal hours of sale on the first Tuesday in May, 2026, namely May 5, 2026, the property conveyed by said Security Deed and described as follows, to-wit (the "Property"): Parcel One: All that certain lot, tract or parcel of land situate, lying and being in the 1380th G.M. District of Bryan County, Georgia, containing 1.827 acres, more or less, as shown on that certain plat of survey made and prepared by John A. Dotson, Georgia Registered Land Surveyor Number 2500, dated December 6, 2000, and recorded in Plat Book 497, Page 9, Bryan County, Georgia records, said plat by specific reference is made a part hereof for descriptive and all other purposes. Said tract or parcel of land bounded, now or formerly as follows: On the Northeast by Interstate 16; on the Southeast by US Highway 280; on the Southwest by other lands of Jeffrey L. Williamson, as Trustee of the Elizabeth Collins Williamson Irrevocable Trust dated December 30, 2013; and on the Northwest by other lands of Jeffrey L. Williamson, as Trustee of the Elizabeth Collins Williamson Irrevocable Trust dated December 30, 2013. Also conveyed is the use of a perpetual 30' slope easement as shown on the plat herein described. District of Bryan County, Georgia, and described as follows: Beginning at a concrete monument located at the intersection of northwest side of the right-of-way of US Highway 280 and the southwest side of the right-of-way of Interstate Highway 16; thence running South 59deg13' West along the northwest side of the right-of-way of US Highway 280 four hundred (400) feet to a concrete monument; thence running North 30deg47' West five hundred fifty (550) feet to a concrete monument; thence running North 59deg13' East five hundred thirty-seven and five hundredths (537.05) feet to a concrete monument; on the southwest side of the right-of-way of Interstate Highway 16; thence running 28deg17" East along the right-of-way four hundred forty and sixty-six hundredths (440.66) feet to a concrete monument; thence running South 16deg17" West along the said right-of-way one hundred sixty and eigthy-two hundredths (160.82) feet to the point of beginning; said property being shown as Tract No. 3 on a plat of survey for Robert J. McCamy and J. Dudley Ottley by Thomas & Hutton Engineering Co., dated July 26, 1965, and recorded in Plat Book C, page 358, Bryan County, Georgia records, said plat by specific reference is made a part hereof for descriptive and all other purposes. LESS AND EXCEPT ALL that certain lot, tract or parcel of land situate, lying and being in the 1380th G.M. District of Bryan County, Georgia, containing 1.827 acres, more or less, as shown on that certain plat of survey made and prepared by John A. Williamson, as Trustee of the Elizabeth Collins Williamson Irrevocable Trust dated December 30, 2013. Because of the default in the payment of the Indebtedness, which the Security Deed was given to secure, the undersigned has declared the entire Indebtedness due and payable, and said Property will be sold as the Property of Borrower to satisfy the Indebtedness together with the cost of said sale, including attorneys' fees, notice having been given pursuant to the Official Code of Georgia Annotated Section 13-1-11. To the best of the undersigned's knowledge and belief, the party in possession of said Property is Borrower and/or tenants claiming by, through, or under Borrower. The Property will be sold subject to all liens, zoning ordinances, encumbrances, easements, covenants, restrictions, and other matters of record to which the Security Deed is junior and inferior to in terms of priority. The Property will be sold subject to any and all unpaid taxes or assessments relating to the Property and all matters as would be disclosed by a current, accurate survey of the Property. The Property will be sold on an "as-is, where-is" basis without recourse against Lender and without representation and warranty of any kind or nature whatsoever with respect thereto. The Property will be sold subject to the right of redemption of any taxing authority. Lender reserves the right to suspend the foreclosure proceeding at any time prior to the acceptance of a bid and to subsequently resume the foreclosure proceeding at a time of its choosing or to rebid upon failure of a successful bidder to consummate the purchase.
